Notice to Class of Proposed Settlement of Franklin v. Kinsley (formerly known as Hawkins v. Cohen)

This notice contains important information regarding a Jan. 13, 2023, court hearing on whether to approve a Settlement Agreement reached to resolve the federal lawsuit filed in 2017. This settlement provides important protections for Medicaid beneficiaries in North Carolina.

Medicaid Access Monitoring Review Plan

A “Medical Assistance Access Monitoring Review Plan” is required by the Centers for Medicare and Medicaid Services (CMS) to determine if those who receive Medicaid services through a fee-for-service model, such as the one used in the current North Carolina Medicaid plan, have sufficient access to care. (Code of Federal Regulations (CFR) Title 42, Parts 447.203, 447.204 and 447.205).

NC Medicaid, as required by CMS in 42 CFR 447.203(b), is requesting public review and comments for its Medicaid Access Monitoring Review Plan.

NC Medicaid is committed to developing solutions that are right for North Carolina, and encourages feedback on the plan.
